![]() ![]() With the recognition of personal budgets in the law, every individual is legally entitled to a personal budget that must be now incorporated in every care and support plan (or support plan for carers), unless the individual is merely getting intermediate care or reablement support to meet their identified needs. This is an important change in the personalizing care and support process as it enables people to have maximum and full control over how their needs are met. For the first time in law, local authorities have a legal obligation to offer personal budgets and conduct a care and support planning that were previously stated only in guidance as part of the Personalization agenda. With the implementation of the Care Act, there is now a duty upon councils to produce a care and support plan and offer a personal budget following an assessment to ensure that disabled people and carers’ needs are adequately met.
